This Acceptable Use Policy ("AUP") governs the use of the ArGen AI performance evaluation platform, website at argen.isira.club, and all related services (collectively, the "Services") provided by ArGen ("we," "us," or "our"). This AUP sets forth the standards of conduct and prohibited activities that apply to all users, including team administrators, members, evaluators, and any other person or entity accessing or using the Services. By accessing or using the Services, you agree to comply with this AUP in full.
1. Prohibited Activities
You may not use the Services for any activity that is illegal, fraudulent, abusive, or that otherwise violates the rights of others or the terms of this AUP. The following is a non-exhaustive list of prohibited activities:
1.1 Illegal or Unauthorized Use: You may not use the Services for any purpose that violates any local, state, national, or international law or regulation, including but not limited to data protection laws (such as GDPR, CCPA), anti-spam laws, intellectual property laws, export control regulations, and sanctions programs. You may not use the Services to store, transmit, or process content that is illegal under applicable law, including child exploitation material, terrorist content, or content that incites violence or hatred.
1.2 Abuse of AI and Evaluation Systems: The Services are designed to evaluate and score human-AI interaction workflows. You may not:
- Submit prompts or inputs that are designed to manipulate, deceive, or "jailbreak" the AI scoring engine to produce artificially inflated or deflated scores;
- Submit the same or substantially identical responses repeatedly in an attempt to distort evaluation results or benchmark data;
- Use automated scripts, bots, or other programmatic means to interact with the evaluation platform in a manner not explicitly authorized by our API terms;
- Attempt to reverse engineer, decompile, or extract the proprietary scoring algorithms, rubric models, or AI agent prompts used within the ArGen evaluation engine;
- Submit adversarial prompts designed to elicit harmful, unethical, or disallowed content from underlying AI models (as defined by the respective model providers' usage policies).
1.3 Data Scraping and Extraction: You may not:
- Use any automated tool, scraper, spider, robot, or data mining technique to extract, copy, or download substantial portions of the Services, including evaluation reports, team analytics, benchmark data, or user profiles, without our prior written consent;
- Aggregate, repackage, or publicly redistribute any data or content obtained from the Services, including anonymized or aggregated benchmark scores, without express written authorization;
- Interfere with or disrupt the integrity or performance of the Services, including by introducing viruses, malware, or other harmful code, or by engaging in denial-of-service attacks.
1.4 Competitive Intelligence Gathering: If you are a competitor or are acting on behalf of a competitor of ArGen, you may not:
- Access or use the Services for purposes of monitoring their availability, performance, functionality, or for any other benchmarking or competitive analysis purpose;
- Create derivative works or imitations of the Services, including the evaluation methodology, scoring dimensions, rubric design, or coaching content;
- Solicit or attempt to solicit ArGen users or customers for purposes of migrating to a competing product or service.
1.5 Harmful Content and Conduct: You may not use the Services to:
- Transmit, store, or link to content that is defamatory, harassing, discriminatory, or abusive, including content that promotes hate speech or violence against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic;
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
- Engage in phishing, credential harvesting, or other deceptive practices intended to obtain unauthorized access to user accounts or personal information.
2. User Account Responsibilities
You are solely responsible for maintaining the confidentiality of your account credentials, including your username, password, and any API keys issued to you. You are responsible for all activity that occurs under your account, regardless of whether such activity was authorized by you. You must:
- Notify ArGen immediately of any unauthorized use of your account or any other breach of security of which you become aware;
- Ensure that all users accessing the Services through your account (e.g., team members you invite to evaluations) are aware of and comply with this AUP;
- Not share, sell, transfer, or sublicense your account, access keys, or subscription to any third party without our express written consent;
- Ensure that any content, prompts, or data you submit through the Services does not infringe upon the intellectual property rights, privacy rights, or other legal rights of any third party.
3. Reporting Violations
We encourage our community to help us maintain a safe and compliant environment. If you become aware of any violation of this AUP, including any suspected unauthorized access, misuse of the evaluation system, or prohibited content, please report it promptly to our abuse team at isiraglobal@gmail.com. Your report should include, to the extent possible:
- A description of the alleged violation, including the specific nature of the activity and the account or user involved;
- The date, time, and approximate location (e.g., feature or URL) where the violation occurred;
- Any evidence or supporting documentation that may assist our investigation;
- Your contact information (optional, but helpful if we need to follow up).
We take all reports seriously and will investigate promptly. We may contact you for additional information and will take appropriate action based on the findings of our investigation.
4. Monitoring and Enforcement
ArGen reserves the right, but does not assume the obligation, to monitor the Services for violations of this AUP. We may investigate any suspected violation and take any action we deem appropriate in our sole discretion, including but not limited to:
- Issuing a warning to the user or account administrator;
- Temporarily or permanently suspending or terminating access to the Services, with or without notice;
- Removing or disabling access to content that violates this AUP;
- Disabling or invalidating evaluation scores, challenge results, or benchmark data that were obtained through prohibited means;
- Reporting the violation to appropriate law enforcement authorities and cooperating with their investigations;
- Pursuing legal action, including seeking injunctive relief and claiming damages resulting from the violation.
We may modify, suspend, or discontinue any aspect of the Services at any time without liability if we determine that continued operation would violate this AUP or applicable law.
5. Consequences of Violation
Violation of this AUP may result in immediate suspension or termination of your account and access to the Services, forfeiture of any prepaid fees, and potential legal liability. Specifically:
- First Violation (Minor): For unintentional or minor violations, we may issue a written warning requiring corrective action within 48 hours. Failure to comply will result in account suspension.
- Second Violation or Serious Breach: For repeat offenses or serious violations (including but not limited to abuse of AI systems, data scraping, competitive intelligence gathering, or distribution of harmful content), we reserve the right to immediately suspend your account without prior notice and permanently terminate the Agreement. No refunds will be issued for terminated accounts.
- Legal Referral: Violations involving illegal activity (including fraud, unauthorized access to systems, and distribution of illegal content) will be referred to the appropriate law enforcement authorities, and we will fully cooperate with their investigations, including providing account records and usage logs as permitted by law and our Privacy Policy.
ArGen's failure to enforce any provision of this AUP shall not constitute a waiver of our right to enforce that or any other provision in the future.
6. Changes to This Policy
We may revise this AUP from time to time. If we make material changes, we will notify you by email (to the email address associated with your account) and/or by posting a prominent notice on the Website prior to the changes becoming effective. Your continued use of the Services after the effective date of the revised AUP constitutes your acceptance of the updated terms. If you do not agree with the changes, you must stop using the Services and terminate your account.
